Terms of Use

These Terms of Use ("Terms") govern your access to and use of the ShineX platform ("Service"), operated by ShineX Technologies ("Company", "we", "us"), based in Quebec, Canada. By accessing the Service, you agree to be bound by these Terms.

Key definitions used in this document:

• Account — Your unique account created to access the Service.
• Subscription — The paid recurring plan that grants access to the Service.
• Free Trial — A limited complimentary period offered to new users.
• Website — ShineX, accessible at shinex.co.

By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. You also acknowledge that you have read and agree to our Privacy Policy, which describes how we collect, use, and protect your personal information in accordance with Quebec's Act respecting the protection of personal information in the private sector (Law 25).

The Service is billed on a recurring basis (monthly or yearly). Your subscription will automatically renew unless you cancel before the end of the current billing period. Cancellation takes effect at the end of the current paid period.

We may modify subscription fees with reasonable prior notice. Changes take effect at the end of the current billing period. Paid subscription fees are non-refundable except as required by applicable law or at Company discretion on a case-by-case basis.

We offer a free trial period. No credit card is required. At the end of the trial, you may choose to subscribe to a paid plan.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current information and notify us immediately of any unauthorized use.

Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to the collection and use of your personal information as described therein.

Under Quebec's Law 25, you have the right to access, rectify, and delete your personal information, to withdraw your consent, and to request data portability. To exercise these rights, contact our Privacy Officer at hello@shinex.co.

The Service and its original content, features, and functionality are and will remain the exclusive property of the Company and are protected by copyright, trademark, and other intellectual property laws.

Any feedback, suggestions, or ideas you submit regarding the Service become the property of the Company. You grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right to use such feedback without restriction.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Scrape, crawl, or extract data from the Service by automated means
• Share your account credentials with third parties
• Interfere with or disrupt the integrity or performance of the Service

To the maximum extent permitted by law, the Company's total liability shall not exceed the amount you paid in the 12 months preceding the claim, or $100 CAD, whichever is greater. The Company shall not be liable for indirect, incidental, special, or consequential damages.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Royalty estimates are based on publicly available data and may not reflect actual payments from SoundExchange or other collecting societies.

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of Quebec.

You agree to first attempt to resolve any disputes informally by contacting us at hello@shinex.co before initiating any formal legal proceedings.

We may terminate or suspend your account immediately, without prior notice, for breach of these Terms. Upon termination, your right to use the Service ceases immediately. You may request a copy of your personal information before or after termination by contacting our Privacy Officer.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice for material changes via email or through a notice on the Service. Continued use of the Service after the effective date constitutes acceptance.
